В статье рассматриваются точки зрения судей Международного трибунала по бывшей Югославии в отношении двух элементов объективной стороны серьезных нарушений Женевских конвенций, а именно: наличие вооруженного конфликта и связь с ним преступных деяний.

Interpretations of Some Elements of the Grave Breaches of the Geneva Conventions by the Judges of the International Criminal Tribunal for the Former Yugoslavia

The article is devoted to the positions of the Judges of the International Criminal Tribunal for the former Yugoslavia on the two elements of the crime of grave breaches of the Geneva conventions, namely, state of armed conflict and nexus of criminal acts with armed conflict.
