Конституционные ориентиры развития местного самоуправления в единой системе публичной власти

В статье обсуждаются некоторые заданные динамикой конституционного регулирования и историческими вызовами направления развития местного самоуправления. Ключевым автор видит усиление человеческого фактора через носящие общинно-солидарный характер формы коллективности, адекватные духу времени и отечественным традициям. Обосновывается позитивно-интегративный (в противовес негативно-ограничительному) характер самостоятельности местного самоуправления, которая не отгораживает его от государства, а обеспечивает условия для лучшего решения вопросов местного самоуправления в едином механизме народовластия. Предлагаются подходы, связанные с изменением понимания отраслевой природы муниципального права, личностной субъектности в местном самоуправлении, территориальной организации муниципальной власти.

The article discusses certain directions of development in local self-government shaped by the dynamics of constitutional regulation and historical challenges. The author identifies the strengthening of the human factor through forms of collectivity that have a community-solidarity nature, which is adequate to the spirit of the times and domestic traditions, as a key aspect. The positive-integrative nature, as opposed to the negative-restrictive nature, of the autonomy of local self-government is justified, emphasizing that it does not isolate local self-governance from the state but ensures conditions for better solutions to local self-government issues within a unified mechanism of popular governance. Approaches related to changing the understanding of the sectoral nature of municipal law, personal subjectivity in local self-government, and the territorial organization of municipal authority are proposed.
