История принятия статьи 429.1 Гражданского кодекса Российской Федерации

В работе рассматривается процесс принятия статьи 429.1 ГК РФ о рамочных договорах и договорах с открытыми условиями, вступившей в силу в 2015 году. Показано, что большинство предложений по изменению первоначального проекта статьи, выдвинутых в ходе законопроектной работы, было отклонено; раскрываются основания для этих решений. При этом отмечается, что в ходе доработки статьи в нее была включена опция определения условий по заявке одной из сторон, которая изначально не предусматривалась.

The article addresses the process of enactment of Article 429.1 of the Civil Code of the Russian Federation on framework contracts and contracts with open terms, which came into force in 2015. It is shown that most of the proposals to amend the initial draft of the article put forward in the course of legislative work were rejected; the reasons for these decisions are disclosed. At the same time, it is noted that in the course of finalising the article, an option to determine the terms at the request of one of the parties, which was not originally envisaged, was included in it.
