Развитие института наследственных сделок в России и США

Настоящая статья посвящена сравнительному анализу развития института наследственных сделок, составленных на случай смерти наследодателя, в России и США. Исследуются исторические предпосылки формирования данного правового института, выявляются общие черты и различия в подходах к регулированию, а также анализируются современные тенденции в практике нотариального удостоверения завещаний, наследственных договоров и иных сделок, определяющих порядок перехода имущества после смерти.

This article is devoted to a comparative analysis of the development of the institution of inheritance transactions drawn up in the event of the death of the testator in Russia and the USA. The historical background of the formation of this legal institution is studied, common features and differences in approaches to regulation are identified, and modern trends in the practice of notarization of wills, inheritance contracts and other transactions determining the procedure for the transfer of property after death are analyzed.
