ВЛИЯНИЕ КОНТРОЛЯ НАД КОРПОРАЦИЕЙ НА ФОРМИРОВАНИЕ ВОЛИ ЮРИДИЧЕСКИХ ЛИЦ В СОВРЕМЕННОЙ ЭКОНОМИКЕ

В представленной работе автор анализирует влияние контроля над корпорацией на формирование воли юридического лица в условиях современной экономики, разграничивая юридический и экономический контроль. Анализ, произведенный в данной работе, позволил выявить, что зависимость корпораций от внешних и внутренних факторов подрывает автономию их воли, ввиду того, что воля юридических лиц формируется под воздействием органов управления и внешних стейкхолдеров.

In this paper, the author analyzes the influence of corporate control on the formation of legal entities’ will in the modern economy, distinguishing between legal and economic control. The analysis conducted in this paper revealed that the dependence of corporations on external and internal factors undermines the autonomy of their will, given that the will of legal entities is formed under the influence of management bodies and external stakeholders.
