Regulation of Judicial Proceedings in the Context of Digitalization and the Permissibility of Using AI in the Administration of Justice in Economic Disputes

This scientific article analyzes the regulation of judicial proceedings in the context of digitalization through the prism of the impact of digitalization on the concept of “stare decisis” in legal systems, as well as the permissibility of using AI in the administration of justice in economic disputes. The relevance of this study is determined by the rapid development of digital technologies and their integration into judicial practice, which also requires a reassessment of traditional approaches to the interpretation and application of the concept of “stare decisis”. The purpose of this study is to study digitalization and its impact on access to justice, including the use of online platforms for filing lawsuits, electronic storage of court decisions, and the automation of court proceedings. The research includes legal and economic scientific works of foreign and domestic scientists. The article examines the empirical basis of the current status of the “stare decisis” concept and the development of digital technologies in the field of judicial proceedings in African countries. This study examines the benefits of integrating digital technologies into the judicial system, including increased transparency and efficiency. It also critically examines the risks involved, such as unequal access to digital resources and the potential for data leakage. In addition, the analysis highlights examples of successful integration of technology into judicial processes, as well as the challenges faced by legal systems operating in conditions of limited infrastructure and lack of resources. It was found that digitalization had a positive impact on the application of the “stare decisis” concept. However, at this stage of development, stare decisis must adapt to the new conditions caused by digitalization, and it is important to balance the approach to digitalization, taking into account both the advantages of new technologies and the need to preserve the fundamental principles of justice. It was also found that the use of AI in the administration of justice in economic disputes is acceptable and stimulates the development of the legal reality of modern states. © 2025 Elsevier B.V., All rights reserved.
